Terms of Service

1. Acceptance of Terms

By accessing or using Remote Copilot ("the Service," "Application," or "Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Remote Copilot is a web-based application that provides a remote interface to control GitHub Copilot within your local Visual Studio Code (VS Code) instance. The Service acts as a communication bridge between your web browser and your local VS Code editor, enabling remote access to AI-powered coding assistance.

  • Web-based interface for GitHub Copilot integration
  • Real-time communication between browser and VS Code
  • Terminal command execution capabilities
  • Repository access and management through GitHub OAuth
  • Agent Mode for automated VS Code interactions

3. User Requirements and Responsibilities

3.1 System Requirements

To use Remote Copilot, you must have:

  • A valid GitHub account with GitHub Copilot access
  • Visual Studio Code installed on your local machine
  • The Remote Copilot VS Code extension installed and configured
  • An active internet connection

3.2 User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your GitHub credentials
  • All activities that occur under your account
  • Ensuring your use complies with applicable laws and regulations
  • Backing up your code and data before using the Service
  • Understanding the security implications of remote access features
  • Any code generated, modified, or executed through the Service

4. Authentication and Access

4.1 GitHub OAuth

The Service uses GitHub OAuth for authentication. By using the Service, you grant us permission to:

  • Access your GitHub username and avatar URL
  • Read access to your public and private repositories
  • Store your GitHub access token temporarily during your session

4.2 Account Security

You agree to:

  • Keep your GitHub account credentials secure
  • Log out after each session
  • Immediately notify us of any unauthorized access
  • Accept responsibility for all activities under your account

5. Data and Privacy

5.1 Code Privacy

Your source code is never stored on our servers. All code processing occurs exclusively on your local machine. The Service functions solely as a communication relay between your browser and local VS Code instance.

5.2 Data Transmission

While your code remains local, the following data may be transmitted through our servers:

  • Prompts and responses (temporarily, not permanently stored)
  • Commands and their outputs
  • Session and authentication data

5.3 Usage Analytics

We use Google Analytics to collect anonymous usage statistics to improve the Service. This data does not include your source code or personal files.

6. Security Considerations and Agent Mode

⚠️ Important Security Notice

Agent Mode Security Requirements: Certain features, including "Agent Mode," require your VS Code to be the active window and your screen to be unlocked for proper functionality. You acknowledge and understand that:

  • These features may interact with your desktop environment
  • Your screen activity may be accessible to the Service during operation
  • You should ensure your workspace is secure before enabling these features
  • You are responsible for any security implications arising from these requirements

7. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Generate malicious code or engage in harmful activities
  • Attempt to reverse engineer or compromise the Service
  • Use the Service for any commercial purpose without permission
  • Interfere with or disrupt the Service's operation
  • Access or attempt to access other users' accounts or data

8. Intellectual Property

8.1 Service Ownership

Remote Copilot and its original content, features, and functionality are owned by the copyright holders and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 User Content

You retain all rights to your source code and content. You grant us a limited, non-exclusive license to transmit your prompts and responses solely for the purpose of operating the Service.

8.3 Generated Content

You are solely responsible for any code generated or modified through the Service, including ensuring it does not infringe on third-party rights.

9. DISCLAIMER OF LIABILITY

9.1 "AS IS" BASIS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

9.2 NO WARRANTIES

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • The quality of any products, services, information, or other material obtained through the Service will meet your expectations
  • Any errors in the Service will be corrected

9.3 LIMITATION OF LIABILITY

IN NO EVENT SHALL THE AUTHORS, COPYRIGHT HOLDERS, OR CONTRIBUTORS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SERVICE OR THE USE OR OTHER DEALINGS IN THE SERVICE.

This includes, but is not limited to:

  • Direct, indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Business interruption or system failures
  • Security breaches or unauthorized access
  • Errors in generated code or automated actions
  • Any damages arising from Agent Mode or screen interaction features

9.4 USER RESPONSIBILITY

YOU ACKNOWLEDGE AND AGREE THAT:

  • You use the Service at your own risk
  • You are solely responsible for any code generated, modified, or executed
  • You should review all generated code before implementation
  • You should maintain appropriate backups of your work
  • You understand the security implications of remote access features

9.5 MAXIMUM LIABILITY

To the maximum extent permitted by applicable law, our total liability to you for all damages, losses, and causes of action shall not exceed the amount you have paid us in the past twelve (12) months, or one hundred dollars ($100), whichever is less.

10. Indemnification

You agree to defend, indemnify, and hold harmless Remote Copilot, its authors, copyright holders, and contributors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including intellectual property rights
  • Any code generated or modified through the Service
  • Any claim that your use of the Service caused damage to a third party

11. Termination

11.1 Termination by You

You may stop using the Service at any time by:

  • Logging out of your session
  • Revoking GitHub authorization
  • Uninstalling the VS Code extension

11.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, for any reason, including if you breach these Terms.

11.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • Any data stored in your session will be deleted
  • You remain liable for any obligations incurred prior to termination

12. Third-Party Services

The Service integrates with third-party services including:

  • GitHub: For authentication and repository access
  • GitHub Copilot: For AI-powered code assistance
  • Google Analytics: For usage analytics

Your use of these services is subject to their respective terms of service and privacy policies.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting the new Terms on this page
  • Updating the "Last Updated" date
  • Providing notice through the Service for significant changes

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable local laws. Any disputes arising from these Terms or your use of the Service shall be resolved through appropriate legal channels in the jurisdiction where the Service operators are located.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
